Parks Construction Permit Insurance Requirements

Permittees are reminded that all Construction Permits issued by the New York City Department of Parks and Recreation (“Parks”) require insurance.  No permit will be issued until the applicant has submitted proof of all required insurance to Parks. 

All required insurance policies shall be maintained with companies that may lawfully issue the required policy and have an A.M. Best rating of at least A- VII or a Standard and Poor’s rating of at least A.   All Certificate(s) of Insurance shall be in a form reasonably acceptable to Parks and shall certify the issuance and effectiveness of the types of insurance specified in the Permit and be accompanied by either a duly executed “Certification by Broker or Agent” in the form specified below or completed copies of all policies referenced in the Certificate of Insurance. Where completed policies have not yet been issued, binders are acceptable.  The Permittee shall be obligated to provide the City with a copy of any policy upon the demand for such policy by Parks or the New York City Law Department.

All Parks Construction Permit applications must have a Certificate of Insurance, which MUST include the following:

• Specific listing of THE CITY OF NEW YORK as additional insured, using the following language:
  THE CITY OF NEW YORK, including its officials and employees is named as an additional insured with respect to operations performed by the named insured at (NAME OF SITE)”.  

  The name of the park must be listed on all Insurance Policies.  Please email Construction Permits at construction.permits@parks.nyc.gov if you are not sure of the name of the park.

• THE CITY OF NEW YORK DEPARTMENT of PARKS & RECREATION must be included as a Certificate Holder, using the following address:

• The name and firm listed on the insurance must match the name and firm to whom the permit is issued. A discrepancy between the information on the insurance certificate and the permit applicant information will result in a delay in processing your application and/or a denial of a permit.

The following are minimum requirements for all Construction Permits.  Parks reserves the right to increase the minimum limits and/or require additional types of insurance.

Commercial General Liability Insurance:

Permittee shall maintain a Commercial General Liability (“CGL”) insurance policy or policies (including umbrella or excess policies, if any) to protect the insureds from claims for property damage and/or bodily injury, including death that may arise from any of the operations under this Permit. Coverage shall be at least as broad as that provided by the most recently issued Insurance Service Office (“ISO”) Form CG 0001. Such CGL insurance shall name “City of New York, together with its officials and employees,” as an Additional Insured with coverage at least as broad as the most recent edition of ISO Form CG 2026. Such CGL insurance shall be primary and non-contributing to any insurance or self-insurance maintained by the City and must be "occurrence" based rather than "claims-made".

Comprehensive Business Automobile Liability Insurance:

Permittee shall maintain Comprehensive Business Automobile Liability insurance for liability arising out of any owned, non?owned, leased and hired vehicles to be used in connection with this Permit. Coverage should be at least as broad as the most recent edition of ISO Form CA0001.
